What is a mortgage release in Morocco?

When you buy a property in Morocco with bank financing, the bank requires a security interest on the property — the mortgage. This mortgage is registered on the title at the National Land Registry (ANCFCC), giving the bank priority over the property in case of default.

The mortgage release (mainlevée) is the symmetric act: the bank's formal declaration that the mortgage is extinguished, typically because the loan is fully repaid. The release must then be registered at ANCFCC to produce its legal effect: removal of the mortgage inscription from the title.

Legal basis: Law 14-07 on land registration (articles on inscriptions and removals, including article 93 on registry requests) + the Dahir of 1913, still in force for the fundamentals of the Moroccan land system.

The real risk of forgetting the release

As long as the release is not registered, your title remains encumbered with an active mortgage inscription visible to all third parties. Three concrete consequences:

  • Sale blocked. A notary will refuse to finalize the authentic deed. You typically discover the problem the day before signing — which can kill the transaction.
  • Refinancing impossible. No new bank will accept to register a new mortgage on an encumbered title.
  • Residual risk. If the original lending bank is restructured or fails, obtaining the release years later becomes substantially harder (proceedings with the liquidator or successor entity).

This is particularly common among Moroccans abroad (MRE) who repaid their loan 5-10 years ago, never requested the release, and now want to sell remotely.

MRE case study — selling 8 years after repayment

Profile: Mrs. R., MRE living in France, owns a Casablanca apartment purchased in 2010 with an 800,000 MAD loan from Attijariwafa Bank. She repaid early in 2018 after selling a property in France. In 2026 she wants to sell the Casa apartment from Paris — a preliminary sale agreement is signed, closing in 4 weeks.

Discovery: her Casablanca notary requests a recent title extract. Surprise: the 2010 Attijariwafa mortgage inscription is still active. The release was never requested or registered in 2018. The notary refuses to close the sale.

Resolution implemented:

  1. Notarized power of attorney from Paris (authenticated at the Moroccan consulate) to mandate a Moroccan lawyer.
  2. Written request to Attijariwafa for the release (day 1).
  3. Bank issues release (3 weeks — 2018 file archived).
  4. Notary authentic deed + ANCFCC filing (weeks 4-5).
  5. Effective ANCFCC removal (day 32).

Total timeline: 5-6 weeks. The preliminary agreement was extended by one month (signed amendment). Total cost: 1,350 MAD in registration fees + 1,800 MAD in legal coordination + notary = approximately 3,150 MAD. Modest compared to a 1.8 MMAD sale at risk, but easily preventable with a release done at repayment in 2018.
