What's an apparent defect?
An apparent defect is visible on attentive inspection of the finished property. Unlike hidden defects, apparent defects must be recorded before or at handover. Once the PV is signed without reservation, the developer owes nothing.
Law 44-00 VEFA provides: (1) 1-year perfect completion warranty for defects reported at handover, (2) 2-year good-working warranty on movable equipment (biennale), (3) 10-year decennial warranty for defects affecting solidity or suitability. All three are triggered by reservations recorded at handover.
