
The deed: notaire or adoul
The notaire
The notaire is the professional most foreign buyers will deal with. Working within a civil-law framework that European buyers recognise, the notaire drafts the deed of sale, verifies the seller's title and capacity, receives and holds the funds, collects the duties payable on the transaction and completes the registration formalities at the land registry. Their function is the legal security of the transaction — and it is a real protection, provided you understand its limits.
Two limits matter for a foreign buyer. First, the notaire does not inspect the building: nothing in the role involves telling you the roof is failing. The adoul
Alongside the notarial profession, Morocco retains the adoul, who draws up authenticated deeds under the traditional system, in Arabic, following its own procedure including homologation by a judge. Adoular deeds remain common, particularly for family transactions, inheritance instruments and certain categories of property and land tenure. Foreign buyers most often proceed by notarial deed, but the appropriate route can depend on the property and the status of its title — a question to raise with your adviser at the outset rather than accepting whichever channel the seller finds convenient. The estate agent: useful, and not neutral
An estate agent brings local knowledge, access to stock that is not advertised online, and genuine negotiating capacity. Foreign buyers should use one — and should be clear-eyed about the relationship. The agent is normally instructed by the seller and paid on completion; their duty runs to their principal and their interest lies in the deal closing. That is a legitimate commercial position, not a defect.
What follows from it is simple: an agent's price opinion is not an independent valuation, and should not be treated as one. Ask who instructs them, how they are paid, and whether they hold the licence and registration required for estate agency activity. Ask for the mandate in writing. The property valuer, or expert immobilier, answers the question none of the parties to the transaction can answer disinterestedly: what is this asset actually worth? A professional valuation is a written, signed report that identifies the property, states the basis of value and the valuation date, sets out the method and the comparable evidence relied on, and carries the valuer's professional responsibility. For a foreign buyer or investor, three attributes matter. Independence: the valuer must have no interest in whether you buy. Standards: valuations prepared to RICS Red Book and IVS standards are the international reference and are read without translation of concepts by foreign banks, auditors and investment committees — see RICS Red Book and IVS in Morocco. Evidence: a valuation is only as good as the comparable transactions behind it, which is where genuine local presence earns its fee.
Note the phrasing on qualifications, because it matters and is often abused in marketing. Individuals are qualified and certified; look for RICS-certified experts within a practice, professional indemnity insurance, and a real track record — not vague claims of institutional accreditation. One point of clarity for buyers from common-law countries: a privately commissioned valuation is usable as free evidence in negotiations and adversarial proceedings; it is not, and cannot be described as, a court-mandated report. Where a matter proceeds to court, the court appoints its own expert.
The lawyer: the only one who is purely yours
The notaire secures the deed; the agent sells; the valuer values. The lawyer (avocat) advises you, in your interest, and represents you if the matter turns contentious. For a clean apartment purchase with clear title, many buyers do not engage one. Engage one when any of the following appear: a company or trust in the ownership chain, an inheritance or undivided ownership, land with development potential or uncertain tenure, an off-plan purchase, a seller in difficulty, or any hint of an existing dispute.

The technical professionals
- Architect. Required for the design and supervision of significant works, and the natural author of a scope of works and the professional to hold a contractor to it. Indispensable if you are renovating — see our guide to renovating an older property.
- Surveyor / topographer (géomètre-topographe). Boundaries, surface areas, plot layouts, and the survey work that supports land registry formalities. Where a boundary is uncertain, this is the professional who resolves it — see the surveyor's role and missions.
- Building inspector / technical expert. Structure, damp, cracks, services. Commissioned by the buyer, before signature or under a condition precedent — see the pre-purchase inspection.
- Property manager. For owners who let, or who are simply absent for most of the year. A distinct role from the agent who sold you the property, and worth contracting separately.
Verification: five questions before you engage anyone
- Who instructs and pays you? The single most informative question in the whole process.
- What is your registration or qualification, and can I see it? Professional registration for notaires and lawyers; the licence and registration required for estate agency activity; professional body membership and indemnity insurance for a valuer; registration with the relevant professional order for architects and surveyors.
- Will you put scope, fees and deliverables in writing before starting? An engagement letter is the norm for serious professionals. Resistance to one is a complete answer.
- Can I speak to two clients with a comparable instruction? References that can be contacted, not testimonials on a website.
- Do you have any interest in this transaction other than your fee? Ask it plainly, and note the quality of the answer.
